Who Pays For A Personal Injury Case?

When you file a personal injury claim, you’re expecting compensation for what you’ve lost. It could be a financial loss, loss of time, or a loss of quality of life due to injuries or mental anguish. Your primary focus is trying to be made whole. Springer & Lyle has first-hand experience with these types of claims and the breakdown of who pays for a personal injury case.

Medical bills, lost wages, or pain and suffering are some types of compensation you can receive but there are also costs associated with a personal injury case. The most common expenses for personal injury claims are contingency fees and ancillary costs.

Contingency Fees

If you’ve ever seen a lawyer claiming “you won’t pay unless you win”, that gives you an idea of how contingency fees work. With a contingency fee agreement, attorneys don’t collect money from their client upfront. They instead deduct a percentage of the proceeds from winning your case. If you don’t have contingency fee agreement, you will have to pay your attorney’s fees out of pocket as the case develops.

Ancillary Costs

All costs associated with conducting your case are normally called ancillary costs. Here’s a breakdown of some ancillary costs:

  • Deposition Transcripts
  • Travel
  • Private Investigators

You can submit a request for the defendant to cover court costs if you win your claim at trial. The judge will include the amount in your judgment. Your award may include service of subpoena fees, filing fees, and some deposition costs.

Who Pays for a Personal Injury Claim?

You or your attorneys will pay to file the actual claim, but the defendant pays damages and court cost if you win. In the beginning during preparation for your case, you’ll take on fees from your legal team but our firm pays these if you have a contingent fee agreement. It’s an advance of expenses that the attorneys will get reimbursed for if you win the case.
