Drunk Driving Accidents Don’t Just Happen to Drunk Drivers

June 3, 2015 By Staff - s.r. Leave a Comment

Drunk DrivingSpringer & Lyle notes that every state in the country now has nearly identical laws involving drunk driving or driving under the influence of drugs. Most cases involve a blood alcohol content  of .08 or above. Other cases rely on the arresting officer’s observations at the scene of the arrest, while others involve actual medical evidence of intoxication or being under the influence of drugs. The issue is that driving under the influence of alcohol or drugs doesn’t only affect that driver. It also affects every other driver, bicyclist or pedestrian around them.

Every year, hundreds of people in the Dallas-Fort Worth Metroplex are injured or killed in accidents that were caused by drunk or impaired drivers. Even when victims survive the crash, their injuries can change their lives. These severe injuries result in significant financial loss for victims and their families. The law in Texas gives the injured party the right to recover damages from drunk or impaired drivers. Punitive damages might also be recovered.

In an effort to limit the recovery of the injured victim, the insurer of the intoxicated or impaired driver will begin their investigation immediately after the crash. Initial claim procedures have been implemented by the insurers and followed by their adjusters after evaluating thousands of claims. Before you discuss your claim with that insurer, discuss it with Springer & Lyle so that you, rather than the insurance company for the drunk driver that caused the crash, have control over the case.

In drunk driving cases, determining the value of the injured party’s case can be complicated. The nature and extent of the injuries must be assessed along with the economic losses which include lost wages and medical expenses. Consideration also has to be given to the health insurance company’s contractual reimbursement claim for medical expenses it has paid.   The liability issues in the case must be considered along with any history of drunk driving that the other party might have. The insurance company on the other side is going to try to limit its losses. It’s important for you to have a personal injury attorney with extensive litigation experience so your case can be fully developed and your recovery can be maximized.

Springer & Lyle aggressively and professionally represents individuals who have been injured in motor vehicle accidents that were caused by drunk or impaired drivers. We’re prepared to file suit on your behalf and try your case in front of a judge or jury to obtain fair compensation for you. Significant injuries deserve significant compensation.
