Making a Will During Coronavirus

With a worldwide pandemic, it’s only natural to think about the need for a will and other estate planning documents. School, work, shopping, and many other activities have gone virtual, so why not download a form and make a will? Many online templates do not comply with state laws, and the will may not be valid. What About Witnesses?

According to Texas law, unless written entirely in the Testator’s handwriting, a will must be signed by two witnesses over the age of 14. There are several ways to accomplish this even with COVID-19 precautions. If there are two individuals who reside in your home over the age of fourteen, they can witness your will and it will simply not be self-proved. You can always reprint and sign the document in front of witnesses and a notary after the shut-in orders are lifted. You can also come into our office where we can provide witnesses and a notary. At Springer & Lyle, we are able to practice social distancing and keep everyone at least six feet apart during the signing ceremony.
